Equipment Rental Terms and Conditions

I. 

The University of Vienna lends the loan item to the borrower. Employees of the Faculty of Philological and Cultural Studies at the University of Vienna and their project partners or student assistants, as well as supervisors of students writing a master's or doctoral thesis at a department of the Faculty of Philological and Cultural Studies, are eligible to borrow items. At the request of the University of Vienna, the borrower must provide proof, prior to the handover of the loan item, that insurance has been taken out against all risks, including transport to and from the place of use. The costs of this insurance shall be borne by the borrower. The borrower confirms that the loan item has been received in perfect condition. The borrower further confirms that he/she is sufficiently trained and qualified to use the loan item properly. The borrower undertakes to handle the loan item with care and to use it exclusively for scientific purposes connected with his/her activities at the University of Vienna, to keep it in a secure place and to return it, generally in person, in proper condition by the agreed date. If the loan item is not returned at the agreed time, the borrower may be excluded from borrowing loan items in the future. If the loan item is not returned by the 20th day following the agreed return date, the University of Vienna may procure a replacement for the loaned device. The costs incurred shall be borne by the borrower. The transfer of the loan item to third parties or its shared use by third parties is prohibited unless the University of Vienna has given its written consent. 

II. 

The borrower shall be liable to the University of Vienna for any damage to the loan item in accordance with the provisions of the Austrian General Civil Code (ABGB), whereby slight negligence is expressly sufficient. If any damage occurs, the borrower must report it to the University of Vienna immediately in writing. The borrower acknowledges that any liability of the University of Vienna for damage arising in connection with this loan is excluded, in particular including any loss of data. The borrower must immediately notify the University of Vienna of any damage to or loss of the loan item and of any other important circumstances relating to it. If there is reason to suspect that a criminal offence has been committed in relation to the loan item, such as intentional damage to property or theft, or if the loan item is lost, the borrower must immediately file a report with the competent security authority and provide the University of Vienna with a copy of the confirmation of the report. 

III. 

The University of Vienna is entitled at any time to demand the early return of the loan item for good cause. Such reasons include, in particular: any breach by the borrower of the contractual obligations imposed upon him/her; an urgent need of the lender to use the loan item for its own purposes; or other equivalent reasons. In such cases, the borrower must return the loan item immediately at his/her own expense. 

IV. 

Any amendments or additions to this agreement must be made in writing. This also applies to any waiver of the written-form requirement. The place of jurisdiction shall be the court with subject-matter jurisdiction in Vienna. Austrian law shall apply, excluding the conflict-of-law rules of private international law and the United Nations Convention on Contracts for the International Sale of Goods. In addition, the Terms of Use of the Faculty of Philological and Cultural Studies at the University of Vienna for the “MediaLab”, which are attached as Annex ./A, shall apply and form an integral part of this agreement. I fully agree to the foregoing loan conditions.

If you borrow or rent a device from the MediaLab, a contract will be signed in which you also agree to the loan/rental conditions.
